ABHI and Fair Civil Justice Memorandum of Understanding

ABHI has a Memorandum of Understanding with Fair Civil Justice, through which we engage in constructive dialogue on how the UK’s legal framework can support equitable access to justice in the public interest. This includes transparency in group litigation, the role of third-party litigation funding, and the need for proportionate safeguards for consumers, industry and the public sector.
Recent cases, including litigation arising from the Post Office Ltd Horizon scandal, have shown that compensation does not always deliver fair outcomes, particularly where third-party funding returns exceed claimant awards, reinforcing the need for transparency and proportionality.
ABHI’s involvement reflects our belief that access to justice should prioritise fairness and meaningful outcomes, with litigation used appropriately and alongside effective alternatives such as dispute resolution and ombudsman services.
